Not financial advice

Pendulum Trader is an educational and trading-psychology coaching tool. It is not, and should not be interpreted as, investment advice, tax advice, legal advice, a recommendation to buy or sell any security or futures contract, or a solicitation of any kind. Nothing produced by the AI coach, shadow-trader personas, tilt detection, journal insights, Hermetic principle articles, blog posts, or emails constitutes personalized financial advice.

Pendulum Trader is not a registered broker-dealer, investment adviser, commodity trading advisor (CTA), commodity pool operator (CPO), futures commission merchant (FCM), introducing broker, or financial planner, and no one at Pendulum Trader is acting in any such capacity. If you need personalized advice, consult a licensed professional in your jurisdiction.

Substantial risk of loss

Trading futures, options on futures, equities, options, forex, cryptocurrencies, and other leveraged or derivative products involves a substantial risk of loss and is not suitable for every investor. You can lose some, all, or — in the case of leveraged instruments — more than the amount you deposit.

Leverage magnifies both gains and losses. A small adverse move can produce a total loss of capital in a very short period of time. You should carefully consider whether trading is appropriate for you in light of your financial condition, investment experience, risk tolerance, and objectives.

Past performance is not indicative of future results

Any reference to past results — whether from your own trading data imported into Pendulum Trader, from hypothetical examples, from testimonials, or from content on our website — does not guarantee future performance. Patterns observed in the past may not repeat. Market conditions change.

Hypothetical and simulated results

Hypothetical or simulated performance results have inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading, are generally prepared with the benefit of hindsight, and do not account for all of the financial risk of actual trading. The ability to withstand losses or to adhere to a particular trading plan despite losses are material points that can adversely affect actual trading results. There are many factors related to the markets in general and to the implementation of any specific trading strategy that cannot be fully accounted for and may materially affect the actual results.

No representation is being made that any account will or is likely to achieve profits or losses similar to those shown inside Pendulum Trader, in our educational material, or in any communication from us.

CFTC Rule 4.41

In compliance with U.S. Commodity Futures Trading Commission Rule 4.41: Hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Also, because the trades have not actually been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight.
